LicenseSoftware License Agreement For MJ's CD Archiver(Please carefully read the agreement in full before you install
and use the software) Definition: "the software" "this software" "the program" "this program" below all refer to the MJ's CD Archiver program and components in the MJ's CD Archiver software package. "the authors" and "We", refer to Mingyi Liu and Jun Xu, the authors of MJ's CD Archiver. “Java Runtime”, “Java Runtime Environment”, “JRE”, “J2SE” all refer to Sun Microsystem's redistributable Java Runtime Environment. “Eclipse”, “SWT” refers to the Eclipse Foundation, the Eclipse platform and Standard Widgets Toolkit redistributable libaries. By using this software you agree to be bound by the terms of this agreement as follows: Grant of license The following license agreement applies to registered version of the program. For license and registration for evaluation copy of the program, please refer to the "evaluation license" section below. This software is being licensed to you by the authors on an "AS IS" basis. You may not distribute any component of the licensed software package to others on any media and/or through any network. If your registration type is personal usage, you may install the software on all or any of the computer(s) owned by you, regardless of Operating System, at ONLY one of your personal residence at any given time (For your information, your registration key could enable the software for all supported Operating Systems). If your registration type is business usage (non-site license), you may install the software on ONLY one computer at any given time. If your registration type is business usage (site license), you may install the software on all the computers at one corporate site at a certain geological location. In all cases, no one other than you yourself is granted the license to use the copy of the software registered to you (except when the registration is site license). You may not decompile, or modify any component of the software package in any way without the written consent of the authors. You may not rent, lease or sublicense the software. You may not export the software into any country prohibited by the United States Export Administration Act and the regulations thereunder. Governing Law This agreement shall be governed by the laws of the State of Massachusetts, the State of Ohio and U.S. federal law. Disclaimer of Warranty THIS SOFTWARE AND ANY OF THE ACCOMPANYING FILES AND COMPONENTS ARE SOLD "AS IS" AND WITHOUT ANY WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. As the software user, you must assume the entire risk of using the program and indemnify the authors and all other contributors of any software components included in the software package. In no case should the authors, Mingyi Liu, Jun Xu, Sun Microsystem, Eclipse Foundation or any other contributor to any of the components of the software, be held responsible for any loss or damage to any data or property or anything else directly or indirectly resulted from the usage of this software. Any liability of the seller or author is limited to product replacement or refund of purchase price at request after any software defect is detected and proven. Evaluation and RegistrationEVALUATION LICENSE The following license applies to the evaluation version of MJ's CD Archiver program. For license of the registered version, please refer to the license agreement above. This software is a shareware. Subject to the terms below, you are licensed to use this software solely for evaluation purposes without charge for a period of 30 days. If you use this software after the 30 day evaluation period, a registration fee of U.S. $20 for personal usage or U.S. $30 for business usage is required (contact authors for site license pricing). PLEASE NOTE THAT ONCE YOU REGISTER, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS UNDER “GRANT OF LICENSE” SECTION ABOVE. Unregistered usage of this software after the 30-day evaluation period is a violation of U.S. and international copyright laws. Distribution of Evaluation Version You may make copies of the evaluation version of the software and/or distribute them through any media to anyone. You may NOT modify any component of the evaluation version of the software package including any type of documentation including license agreement. You may not charge for distribution of the software and you may not resell the software. You may not decompile, or modify any component of the software package in any way without the written consent of the author. You may not rent, lease or sublicense the software.
